This session is designed to give attendees an overview of Michigan entrapment doctrine with a particular focus on entrapment arguments in the “Skip the Games” sting cases that have proliferated under the aegis of the Genesee County Sheriff’s Department.

Session Take-Aways

At present, Michigan entrapment doctrine is muddled.

Current doctrine comprises two theories: impermissible inducement and reprehensible police conduct.

“Reprehensible” in this context is a term of art that asks whether police tactics were a proper use of governmental power.

There are viable entrapment arguments in Skip the Games sting cases.

Under Michigan law, entrapment issues are decided by the trial court, not the jury.

Sofia Nelson and Erin Van Campen work for Neighborhood Defender Service of Detroit. In addition to working as a trial public defender, Sofia is the current chair of the Michigan State Bar’s Criminal Law Section. Erin is a research and training attorney, providing support to the Wayne County Assigned Counsel roster and the NDS staff. She also teaches Criminal Procedure at Wayne State Law School. They both have experience litigating creative law reform issues in Michigan’s appellate courts. This training was inspired by recent successes using Michigan’s Constitution, such as the Michigan Supreme Court decision in People v Montez Stovall, a case litigated by Sofia.

PRESENTER PROFILE:

Blase Kearney is a clinical professor at the University of Texas at Austin School of Law. Prior to that, he was a supervising attorney at NDS Detroit and the Public Defender Service for the District of Columbia. He trains and consults on special litigation matters and teaches trial practice skills at UT Austin.

DESCRIPTION:

Michigan is rare among jurisdictions in having preliminary hearings that do not permit most hearsay, and robust Confrontation Clause jurisprudence. However, in practice, courts routinely permit hearsay that is not admissible under the rules of evidence or the Constitution. Mastery of the hearsay rules and confrontation jurisprudence is necessary for any defense lawyer to advocate forcefully to judges and prosecutors who have an overly expansive view of what the law permits.

This session will cover more challenging guidelines issues such as Dupree and Beck challenges, how out of state prior convictions affect guidelines, how to score Ovs 11, 12, and 13, and more. A good understanding of the guidelines or attendance at part two is recommended.

TAKE AWAYS:

Understand how non‑scorable misdemeanors interact with the 10‑year gap
Learn how to categorize and score out of state priors
Apply People v. Dupree to OVs 1 and 2 and see how the same reasoning can be extended to other OVs.

Description of the event: For thirty years, 18 U.S.C. § 925(c) sat unfunded — a statutory remedy no client could actually use. That changed with the DOJ’s 2026 final rule, and the first application window is now open to a limited national pool. This session covers who qualifies, why state expungement and set-asides do not restore federal rights, and what a complete application requires: the records, the psychiatric and substance-abuse evaluations, character references, the personal statement, and the constitutional argument. Attendees receive a filing checklist and brief structure, plus guidance on counseling former clients about eligibility and timing

Takeaways:

Screen a former client for § 925(c) eligibility — identify disqualifying convictions, the records required, and the threshold facts that determine whether an application is viable.
Explain to a client why a state expungement or set-aside does not restore federal firearm rights — and what federal relief actually requires.
