This presentation will focus on areas in which the Michigan Constitution varies from the United States Constitution and how to use those differences to your client’s advantage. Viewers will learn about recent decisions adopting or suggesting arguments for greater protections for the accused under Michigan’s Constitution, and how to most effectively litigate these issues.

Presenters
Sofia Nelson and Erin Van Campen
Sofia Nelson and Erin Van Campen work for Neighborhood Defender Service of Detroit. In addition to working as a trial public defender, Sofia is the current chair of the Michigan State Bar’s Criminal Law Section. Erin is a research and training attorney, providing support to the Wayne County Assigned Counsel roster and the NDS staff. She also teaches Criminal Procedure at Wayne State Law School. They both have experience litigating creative law reform issues in Michigan’s appellate courts. This training was inspired by recent successes using Michigan’s Constitution, such as the Michigan Supreme Court decision in People v Montez Stovall, a case litigated by Sofia.
